“Harold’s Cross Surgery” Terms and Conditions ( T&C’s) 

Introduction

These Terms and Conditions (“Terms”, “Agreement”) govern your use of the services provided by Harold’s Cross Surgery, located at 254 Harold’s Cross Road, Dublin 6W, D6W F789, Ireland, trading online as STDClinic.ie (“the Clinic”, “we”, “our”, “us”).
By booking an appointment, attending the Clinic, or using our website, you agree to these Terms.

If you do not agree with these Terms, you should not use our services.

1. Definitions

  • “Site” means https://stdclinic.ie and all associated pages.
  • “Service(s)” means any medical consultation, test, procedure, appointment, laboratory service, or product we provide.
  • “Patient”, “you”, “your” means any person booking or using our Services.
  • “Appointment” means any scheduled visit booked via the Site, phone, or in person.

2. Scope of Services

2.1 We are GUM/STD/STI/ED Specialists/Consultants, and we do not provide General Practitioner consultation in our Clinic.
2.2 We provide sexual health services, erectile dysfunction services, blood testing, laboratory sample collection, prescription for medications and other health-related services as listed on our website.
2.3 All services are subject to availability. We may decline any booking request at our discretion.
2.4 Medical assessments or procedures may only be performed when clinically appropriate as determined by a qualified practitioner.

3. Booking Appointments

3.1 Appointments must be booked via our website or as otherwise instructed.
3.2 An appointment is considered confirmed only when you receive an email confirmation.
3.3 You must provide accurate personal details when booking. Providing false or incomplete information may result in cancellation.
3.4 To allow other patients to access health service, only one appointment per patient per day is permitted (name/surname/email/phone number).
Duplicate identities (different emails for same person) are not allowed.
Multiple appointments may be cancelled.
3.5 We may correct errors in appointment type or pricing if a patient selects the wrong procedure. Additional fees may apply.
3.6 A minimum charge (consultation fee) applies to all visits, even if the selected procedure is not completed.
3.7 We reserve the right to reject or cancel your booking request.

4. Pre-payments, Deposits & fees

4.1 First-time patients may be required to pay in full or pay a deposit at the time of booking.
4.2 Deposits are applied toward the cost of your appointment.
4.3 Prices for procedures are listed on our website and apply at the time of booking.
Unpublished prices can be requested directly from the Clinic.
4.4 We reserve the right to update or correct pricing errors at any time. If a price increase affects your confirmed booking, you will be notified and may cancel without penalty.
4.5 Price reduction can occur at the discretion of the management of the clinic only.

5. Cancellations, No-shows & Refunds

5.1 Cancellation by the Patient

  • If you need to cancel/reschedule appointment, you must cancel online via the cancellation link provided in the booking confirmation email
  • Cancellation is possible up to 3 hours before your scheduled appointment time
  • By exception we might allow late cancellation which is less than 3 hours before your scheduled time Phone cancellations are only accepted during operating hours
    If that occur, you must call the Clinic on 01 5385515 and immediately advise us
  • Failure to attend or failure to cancel may result in restricted access to future bookings

    5.2 Refund Policy

    • Payments, deposits, and fees are non-refundable, including in cases of no-show or late cancellation
    • If you prepay more than the required consultation or procedure fee, the excess will be deducted from your balance on the day of your appointment
    • If you prepay less than the required consultation or procedure fee, the credit will be added to your balance on the day of your appointment

    5.3 Cancellation by the Clinic

    We may cancel or change your appointment due to:

    • practitioner availability
    • medical necessity
    • operational issues
    • force majeure events (see Section 13)
    • pricing or booking errors

    We will notify you as soon as reasonably possible. If we cancel, you may rebook without penalty.

    6. Sample collection, Processing & Results

    6.1 All samples are processed by independent accredited laboratories.
    6.2 Estimated result times:

    • STD urine/blood tests: 3–7 working days (Mon–Fri, excluding bank holidays)
    • ED blood tests: 3–30 working days (Mon–Fri, excluding bank holidays)

    6.3 If results for STD tests are delayed more than 14 working days, the Clinic will offer a free retest.
    6.4 If a sample cannot be processed (partially or fully), we will contact you to arrange a free retest within 21 days of the original sample date.

    • In exceptional cases, this may be extended to 30 days based on the individual basis
    • Our decision on retest eligibility is final

    6.5 Failure by the patient to attend a scheduled retest within the required timeframe voids the free retest entitlement.
    6.6 We are not responsible for delays or failures caused by third-party laboratories.

    7. Patient Responsibilities

    You agree to:

    • Provide accurate and complete information
    • Attend on time for your appointment
    • Follow clinical instructions before and after testing
    • Not misuse booking systems or attempt to schedule multiple same-day appointments
    • Update us immediately if your contact information changes

    8. Medical Advice Disclaimer

    8.1 All assessments and decisions are made by qualified medical professionals.
    8.2 Information on the Site is not a substitute for personalized medical advice.
    8.3 Services are provided on a clinical-judgment basis. We are not obligated to perform any procedure deemed medically inappropriate.
    8.4 Treatment outcomes are not guaranteed.

    Please note, we cannot accept responsibility for any services which do not form part of our contract.
    This includes, for example, any additional services or facilities which any supplier agrees to provide for you where the services or facilities are not advertised in our leaflet or website and we have not agreed in writing to arrange them.

    9. Liability

    9.1 The Clinic is liable only for losses caused by our negligence and only to the extent allowed under Irish law.
    9.2 We are not liable for:

    • indirect, incidental, or consequential losses
    • losses caused by third-party laboratory processing
    • inaccurate information provided by patients
    • missed appointments, late cancellations, or failure to follow instructions

    9.3 Nothing in these Terms limits liability for:

    • death or personal injury caused by negligence
    • your statutory rights relating to medical negligence
    • fraud or fraudulent misrepresentation
    • rights that cannot be limited under Irish or EU law

    9.4 Our total liability for any claim is limited to the amount paid for the Service in question.

    10. Testimonials, Documentation & Receipts

    10.1 Patients may request medical documentation, certification, or proof of procedure.
    10.2 Receipts for tax or insurance reimbursement will reflect the exact name of the procedure provided to you, as listed on our website.

    11. Use of Website

    11.1 You must not misuse the Site by:

    • attempting to gain unauthorized access
    • scraping or copying content
    • introducing viruses or harmful code
    • interfering with booking systems

    11.2 Failure to comply may result in suspension or permanent ban.
    11.3 We may suspend access to the Site for maintenance, updates, or security reasons.

    12. Privacy and Data Protection

    12.1 Your personal data is processed according to our Privacy Policy available on our website.
    12.2 By using our services, you consent to data processing for appointment management, medical analysis, diagnosis, and clinical communication.
    12.3 You can exercise your GDPR rights by contacting our Data Protection Officer via the contact options listed in the Privacy Policy.

    13. Force Majeure

    We are not liable for failure to perform our obligations due to events beyond our control, including but not limited to:

    • natural disasters
    • strikes
    • power failures
    • pandemics
    • IT failures
    • laboratory disruptions
    • government restrictions

    In such cases, services may be delayed, cancelled, or modified.

    14. Governing Law & Dispute Resolution

    14.1 These Terms are governed by the laws of Ireland and applicable European Union regulations.
    14.2 Any disputes will be subject to the exclusive jurisdiction of the Irish courts in Dublin.
    14.3 We encourage patients to contact us first to resolve any issue informally.

    15. Changes to the Terms and Conditions

    15.1 We may update these Terms from time to time.
    15.2 Changes take effect when posted on the Site. Continued use of our services constitutes acceptance of the updated Terms.
